In competition law, we successfully represented an insurance broker in a claim alleging abuse of a dominant position by an operator that prevented it from developing its business. Also in the brokerage market, we acted for a major emerging operator in its complaint against anticompetitive practices by some of the sector’s leading players.
We also have experience in merger control, having handled numerous notifications to the Spanish competition authority (CNMC) affecting the insurance sector.
At the regulatory level, we regularly advise on legal issues relating to health insurance, including the transfer of risk inherent in insurance activities to third-party operators and the legal implications of modifications to commercial terms between insurers and MUFACE.
We also counsel a range of insurance operators on matters of regulatory compliance and their dealings with supervisory authorities, including inspection procedures, the adoption of special control measures, and even revocation of authorizations. We have secured judicial annulment of some of the most significant decisions adopted by the regulator in this area.
